Please indicate below a 1st, 2nd and 3rd chioce of booth configuration. Every effort will be made to honor your request. Booths are available on a first come first serve basis. Exibitors that do not specify a 2nd or 3rd choice may be assigned a smaller/larger booth at the discretion of the show management.

Payment Terms: Payment for your first choice plus any rentals or electrical must be received in full no later than March 16, 2009. Any balance will be refunded to you prior to the event.

Cancellation Policy:We can offer a 50% refund through March 31, 2009.

EXHIBITORS TERMS AND CONDITIONS

CONTRACT: FOR MONTCLAIR ART IN THE PARK

Terms and Conditions of Agreement between Exhibitors and Management

Exhibitor acknowledges that Functional Design and Arts, LLC (hereafter, Manager) is an agent of Montclair Cooperative School and has been retained to perform all management, leasing and operational aspects of the event, including, but not limited to coordinating marketing services, jury management, booth placement and liaison services between exhibitors and event organizers.

Exhibitor agrees to cooperate with any security programs adopted for the show site.

Montclair Cooperative School reserves the right in its sole discretion to change the show dates and venue.

Functional Design and Arts, LLC and the Montclair Cooperative School reserves the right to reject any and all applications for any reason or no reason at all and to prohibit, close, correct, remove or eliminate any exhibit, in part or in whole, or any other material, circumstance, conduct or action which is not suitable to or in keeping with the character of the show or which violates these rules or laws.

Payment for the space must be received in full prior to the Show. If payments are not made by the exhibitor as required, Manager may at its option terminate this application without notice, or consider exhibitor last in priority when assigning available booth spaces. An application is a commitment to the show. Exhibitors cancelling will receive no refunds.

No exhibitor shall use any flammable decorations or covering for display fixtures and all fabrics or other material used for decoration or covering of displays shall be fireproof.

Exhibitor must confine its activities to its own booth during show hours.

Manager and the Montclair Cooperative School reserve the right to refuse admission to any person or persons, including exhibitors or their assigns, in the interest of safety and welfare.

Exhibitors may not display or distribute signs, brochures, fliers, samples, advertising devices, etc. outside their booth. Exhibitor shall not cause disturbances, create noxious fumes or make noise which may be offensive to other exhibitors or the general public.

Exhibitors or their assigns may not sponsor any event that conflicts with Manager's and The Montclair Cooperative School's sponsored programs during the show.

Exhibitors shall provide timely information to Manager for listing in the Official Directory of the Show. The Official Directory is a listing of exhibitors and although strict precautions are taken during proof-reading, Manager or its assigns are not liable for any errors or omissions in the exhibitor listing. Tenants whose applications arrive after the deadline will not be listed.

By signing an application for a show, exhibitor agrees that the manager, Montclair Cooperative School and their respective partners, directors, members shareholders, trustees, officers, agents and assigns (hereafter, Show Entities) shall not be held accountable or liable for and the same are hereby released from accountability or liability for any damage, loss, harm or injury to the person or property of he applicant and any of its assigns resulting in theft, water, fire accident or any other cause and that the Show Entities will not obtain insurance against any such harm, injury, damage or loss. Exhibitor and the Show Entities agree that all the property of the exhibitor is to remain in the exhibitor's custody and control in transit to, from and within the show site. It is understood between the exhibitor and the Show Entities that the exhibitor is merely provided with the opportunity to sell and display their work to persons attending the show.

Exhibitors must comply with all local, state and federal laws, codes, rules and regulations and fire ordinances in force from time to time affecting the show site.

All rights and remedies under this application shall be cumulative and none shall exclude other rights and remedies allowed by law. Exhibitors in violation of the above conditions, rules and regulations governing the show are subject to prompt disqualification from participation in this and future shows.

The laws of the State of New Jersey shall govern the validity and performance of this agreement. The invalidity or unenforceability of any provision of this agreement shall not affect or impair any other provision.
